If you create a firm listing on our platform, you agree to:

  • Not use the listing for fraudulent or misleading purposes
  • Respect the intellectual property rights of others

We reserve the right to remove or suspend any firm listing that violates these Terms or applicable laws.

Subscriptions and Payments

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability to you for all claims arising from or related to the Services shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.

Indemnification

You agree to indemnify, defend, and hold harmless The Firm Media, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Services, your User Content, your violation of these Terms, or your violation of any rights of another party.

Dispute Resolution

If you have a dispute with us, you agree to first contact us to attempt to resolve the dispute informally. If we cannot resolve the dispute within sixty (60) days, the dispute resolution process will depend on your jurisdiction, as outlined in the "Jurisdiction-Specific Terms" section below.

You agree that any dispute arising out of or relating to these Terms or the Services will be resolved on an individual basis and not as part of a class action or representative proceeding.

Jurisdiction-Specific Terms

Australia

If you are located in Australia, these Terms are governed by the laws of Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Australia.

Australian Consumer Law: Nothing in these Terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law or any other applicable consumer protection legislation that cannot be excluded, restricted, or modified.

If you are a consumer under the Australian Consumer Law, you may be entitled to certain guarantees. If we fail to meet a guarantee, you may be entitled to remedies including a refund, replacement, or compensation for damages.

United Kingdom

If you are located in the United Kingdom, these Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

UK Consumer Rights: If you are a consumer in the UK, you have certain statutory rights under the Consumer Rights Act 2015 and other applicable legislation. These Terms do not affect your statutory rights.

If you are a business customer, you acknowledge that you have the authority to bind your business to these Terms and that you are not acting as a consumer.

United States

If you are located in the United States, these Terms are governed by the laws of the jurisdiction where The Firm Media operates, without regard to its conflict of law provisions. Any disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

Class Action Waiver: You agree that any disputes will be resolved on an individual basis and waive your right to participate in a class action lawsuit or class-wide arbitration.

Some states do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, so some of the above limitations may not apply to you.
